inSpeak Privacy Policy
inSpeak and Global
Unicom, LLC (collectively referred to as "inSpeak") are committed
to protecting your privacy. Please read this inSpeak Privacy Statement for
all inSpeak services that you may use. This inSpeak Privacy Statement
applies to data collected by inSpeak through its inSpeak site(s) and
service(s). This Privacy Statement also contains a section with specific
details regarding personal information collected from children.
When you install inSpeak or signup for an inSpeak username, you consent to
our use and disclosure of your personal information in the manner described
in this Privacy Statement. This Privacy Statement is incorporated into and
subject to the terms of the inSpeak End User License Agreement
("EULA").
What this Privacy
Policy Covers
This Privacy
Statment covers inSpeak's treatment of personally identifiable information
that inSpeak collects when you are on the inSpeak site, when you use
inSpeak's services, or when you purchase products or services from inSpeak.
This Privacy Statement also covers inSpeak's treatment of any personally
identifiable information that inSpeak's business partners share with
inSpeak.
This Privacy Statement does not apply to the practices of companies that
inSpeak does not own or control, or to people that inSpeak does not employ
or manage, including without limitation, any inSpeak affiliates or business
partners. This Privacy Statement does not apply to information that is
available to other inSpeak users through your profile or exposed to other
inSpeak users by your use of any inSpeak services or products.
Notification of
Changes
This Privacy Statement
may be revised. We will notify you if any revisions materially change the
manner in which we use or disclose your personally identifiable information
from that stated at the time we collected the information, Any material
changes will be effective only after we provide you by e-mail with at least
30 days' notice of the amended Privacy Statement. Such notices will be sent
to the last known email address you have provided to us. We will also post
the amended Privacy Statement at our web site so that you can always review
what information we gather, how we might use that information, and whether
we will disclose it to anyone. Please check the inSpeak web site at
www.inspeak.com at any time for the most current version of our Privacy
Policy.
Collection and Use of
Personal Information
When you create an
inSpeak username, you will be asked to enter your first and last names,
your age and gender, an e-mail address, your country of residence and (if
applicable) your state of residence, a URL reference, a secret question, an
answer, and password. We may also collect additional data from you,
including demographic information, preferences, interests, and favorites.
In addition, you may enter additional information in the profile for your
nickname, including a picture in gif or jpg format. Information collected
by inSpeak may be combined with information obtained from inSpeak or other
inSpeak companies.
If you choose to sign up for a paid subscription service (such as permanent
rooms, a different colored nickname etc.), we will collect additional
information, such as your credit card number and billing address, that is
used to create an inSpeak billing account.
We may collect information about your visit, including the pages you view,
the links you click and other actions taken in connection with inSpeak
sites and services. We also collect certain standard information that your
browser sends to every website you visit, such as your IP address, browser
type, hardware identification and language, access times, and referring Web
site addresses.
Global Unicom, LLC may
also obtain information about you through the monitoring or recording of
your activities while you are using the inSpeak program or services. You
have consented to such monitoring or recording by agreeing to the
provisions of the End User License Agreement when you installed or used the
program. Any personal information obtained through such monitoring or
recording will be treated in the same manner as all other information
referenced in this Privacy Statement. Such monitoring or recording,
however, will only take place under the circumstances set forth below.
Global Unicom, LLC. wants
you to enjoy inSpeak with the minimum of intrusions. Unfortunately, there
are people who use internet chat room services like inSpeak to harass other
users or engage in criminal activity. Thus, in the course of administering
inSpeak, we may visit and monitor activity in a chat room without the
knowledge of the room owner or room participants in order to determine
whether any rules or polices of inSpeak are being violated, or whether any
illegal activity is taking place. However, we do not regularly monitor chat
rooms. We may monitor a chat room under the following circumstances:
1. We are requested to do so by a room owner or room
admin; or
2. We have reason to believe that illegal activity, or
activity that violates inSpeak rules and policies, is taking place in the
room.
When we decide to monitor
a room, we will do so only as long as necessary to determine whether any illegal
or improper activity is taking place. We may, but we are not obligated to,
notify the room owner, room admins, or room participants of our presence in
the room.
Use of Personal
Information
inSpeak collects and uses your personal information to operate inSpeak and
deliver the services you have requested. These services may include the
display of customized content and advertising based upon the information we
have collected. In order to provide services, your information may be
accessed and used by inSpeak to provide such services. Any use of such
information within inSpeak will remain subject to the limitations of this
privacy statement.
We also use your personal information to communicate with you. We may send
service communications such as welcome letters, billing reminders,
information on technical service issues, and security announcements. We may
also occasionally send you product surveys or promotional mailings to
inform you of other products or services available from inSpeak and its
affiliates.
inSpeak does not sell, rent, or lease its inSpeak customer lists to third
parties. We may, from time to time, contact you on behalf of external
business partners about a particular offering that may be of interest to
you. In those cases, your personal information (e-mail, name, address,
telephone number) is not transferred to the third party. We do not use or
disclose sensitive personal information, such as race, religion, or
political affiliations, without your explicit consent.
inSpeak may access and/or disclose your personal information if required to
do so by law or in the good faith belief that such action is necessary to:
(a) conform to the edicts of the law or comply with legal process served on
inSpeak or the site; (b) protect and defend the rights or property of
inSpeak; or (c) act in urgent circumstances to protect the personal safety
of users of inSpeak services or members of the public. We may transfer
information about you if inSpeak is acquired by or merged with another
company.
Personal information collected on this site may be stored and processed in
the United States
or any other country in which inSpeak or its affiliates, subsidiaries or
agents maintain facilities, and by using this site, you consent to any such
transfer of information outside of your country.
Control of Personal
Information
Some services
offered on inSpeak may collect personal information that is not accessible
via inSpeak directly. However, in such cases, you may be able to access
that information through alternative means of access described by the
service. Or you can write us by using our Web form, and we will contact you
regarding your request.
We may delete your sign-in credentials if they remain inactive for an
extended period of time. Inactivity is defined as a failure to sign in to
any site or service on the inSpeak Network using your username. If your
username or associated account may be made inaccessible if it remains
inactive for 120 days. If we delete your sign-in credentials we will also
delete any account information you have provided to inSpeak.
Security of Personal
Information
inSpeak is committed to
protecting the security of your personal information. We use a variety of
security technologies and procedures to help protect your personal
information from unauthorized access, use, or disclosure. For example, we
store the personal information you provide on computer systems with limited
access, which are located in controlled facilities. When we transmit highly
confidential information (such as a credit card number or password) over
the Internet, we protect it through the use of encryption, such as the
Secure Socket Layer (SSL) protocol.
Cookies and Web
Beacons
inSpeak may set and
access inSpeak cookies on your computer.
inSpeak allows other companies that are presenting advertisements on some
of our pages to set and access their cookies on your computer. Other
companies' use of their cookies is subject to their own privacy policies,
not this one. Advertisers or other companies do not have access to inSpeak's
cookies.
inSpeak uses web beacons to access our cookies inside and outside our
network of web sites and in connection with inSpeak products and services.
Your Ability to Edit and
Delete Your Web Account Information and Preferences
You have the right to access, verify and update your inSpeak web account
Information and preferences in "My inSpeak" section at any time,
including whether you want inSpeak to contact you about specials and new
products.
However, you have no access to delete any of your nicknames created on the
inSpeak Communicator . All nicknames remain in our database for at least 6
months after being created and are only deleted by the inspeak
administration officers at any time.
You may request deletion of your inSpeak web account by visiting MyinSpeak
section at www.inspeak.com, The following information, however,
may possibly remain in our archived records after your account has been
deleted: transactions history about bought services and their dates;
reference numbers.
Collection and Use of
Children's Personal Information
When inSpeak
collects age information and users identify themselves as between 13 and 17
(or below 13), we will obtain consent from the individual on the initial
login that the terms of service must be agreed to. If we change this
inSpeak Privacy Statement in a way that expands the collection, use or
disclosure of children's personal information to which a parent has
previously consented, the parent will be notified and we will be required
to obtain the parent's additional consent. Parents can change or revoke the
consent choices previously made, and review, edit or request the deletion
of their children's personal information, by emailing www.inSpeak.com.
Please note that if you grant consent for your child to use inSpeak
services, this will include such general audience communication services as
inSpeak Groups, inSpeak Private Messenger, inSpeak video, and your child
will be able to communicate with, and disclose personal information to,
other users of permissible ages. We encourage you to talk with your
children about communicating with strangers and disclosing personal
information online.
